Give & Grow Charity Donation (“Donation”)
OFFICIAL RULES
1. OPEN TO ALL RESIDENTS ALASKA, ARIZONA, ARKANSAS, CALIFORNIA, COLORADO, CONNECTICUT, DELAWARE, DISTRICT OF COLUMBIA (“D.C.”), FLORIDA, GEORGIA, HAWAII, IDAHO, IOWA, KENTUCKY, LOUISIANA, MARYLAND, MICHIGAN, MINNESOTA, MISSOURI, MONTANA, NEBRASKA, NEVADA, NEW MEXICO, NEW YORK, NORTH CAROLINA, NORTH DAKOTA, OHIO, OREGON, RHODE ISLAND, SOUTH CAROLINA, SOUTH DAKOTA, TENNESSEE, TEXAS, VERMONT, VIRGINIA, WASHINGTON, WISCONSIN, WYOMING AND WEST VIRGINIA. Donation period begins on May 1, 2023 at 12:00 am (ET) and ends August 31, 2023 at 11:59 pm (ET).
2. ELIGIBILITY: For Donations to be eligible for the charitable contribution by Torresella Wines (‘Sponsor”), they must be made by legal residents of Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, District of Columbia (“D.C.”), Florida, Georgia, Hawaii, Idaho, Iowa, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Mexico, New York, North Carolina, North Dakota, Ohio, Oregon, Rhode Island, South Carolina, South Dakota, Tennessee, Vermont, Virginia, Washington, Wisconsin, Wyoming and West Virginia who are 21 years of age or older at the time of entry. Employees of Sponsor, officers, directors, shareholders, members of employees immediate families (family members include spouses, parents, siblings, children, son-in-law, daughter-in-law, all lineal descendants, including those by adoption, or any other household member) of Sponsor, their affiliates or subsidiaries, their advertising agencies, licensed alcohol beverage retailers and wholesalers, or any other alcohol beverage licensee, employees of alcohol beverage agencies and any other company involved with the design, production, execution or distribution of this promotion are not eligible to donate directly in this capacity. Purchases not meeting all of the requirements stated herein will be ineligible for a charitable contribution. All federal, state and local rules and regulations apply.
3. HOW TO DONATE. There are two (2) ways to donate. Once wine purchase is complete, visit //torresellawines.com/giveandgrow and follow the instructions to upload a copy of your receipt and select the charity you wish to have your donation made to; Standard data fees may apply. See your wireless carrier for pricing plan details. Check your wireless phone capabilities for specific instructions; OR send your qualifying receipt along with your name, address, email address (optional) and your chosen charity to Torresella Give and Grow Donation c/o Beverage Promotions, 20280 N. 59th Ave. Ste 115-550, Glendale, AZ 85308. Donation period begins May 1, 2023 at 12:00 AM ET and ends August 31, 2023 at 11:59 PM ET. There is no limit to the number of Torresella bottles purchased and uploaded per person. Available for both on premise and off premise purchases.
4. DONATIONS. Donations will be made to Oceanic Global and Arbor Day Foundation. See //oceanic.global/ and //www.arborday.org/ for more details on the charities. Sponsor will donate $.50 per 750ml bottle of Torresella Prosecco DOC, Torresella Prosecco Rose DOC, or Torresella Pinot Grigio Venezia DOC purchased by eligible individuals, donating up to A TOTAL OF $50,000! Receipts must show the number of bottles and the brand name, along with the purchase date that must fall within the program period.
5. PRIVACY POLICY: Sponsor shares your concerns about the privacy of your personal information. Sponsor’s privacy policy can be viewed at //www.torresellawines.com/privacy-policy/.
6. GENERAL CONDITIONS. The Sponsor and its affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Program, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) are not responsible for late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, or garbled submissions; or for any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, including the processing, non-receipt or rejection of any submissions. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. By submitting a donation under the Program, you agree that: (a) all disputes will be resolved under applicable U.S. laws in the State of Florida; (b) any and all disputes, claims and causes of action arising out of, or connected with, the Program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal, state or local court located in the State of Florida; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (d) to the extent allowed by applicable law, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
